Adu-Boahene Re-Arrested at Midnight After Court-Ordered Release – Lawyer Cries Foul Over EOCO Tactics

Lawyer for the embattled former Director General of the National Signals Bureau, Kwabena Adu-Boahene, has accused the Economic and Organized Crime Office (EOCO) of engaging in tactics that undermine justice after his client was re-arrested at midnight just hours after a court had ordered his release.

Speaking to journalists at the courthouse on Tuesday, May 13, 2025, Samuel Atta Akyea expressed deep concern over what he described as an orchestrated plan by state actors to prolong Adu-Boahene’s detention.

“At the last sitting, the judge ordered that he should have his freedom yesterday and they said they have another matter that they are investigating concerning him, so when he was supposed to have his freedom, by their calculation, they released him at midnight and then re-arrested him on the new found matters they were looking at.” He said.

He questioned why the authorities waited until the exact expiration of the remand to re-arrest his client instead of addressing the supposed new case while he was in custody. “The question is, in the period in which he had the freedom, why didn’t they deal with the matter? And they will leave it to midnight and re-arrest him.” He added.

The lawyer, who is also a Member of Parliament, criticized the move as a personal vendetta rather than a lawful pursuit of justice. “It’s somebody very excited, incarcerating another Ghanaian with all manner of tactics who hate justice, and that is unfortunate.” He said.

Atta Akyea confirmed that his client was currently being held by EOCO over a new investigation allegedly linked to a contract involving the Ghana Water Company Limited (GWCL)  and National Security for internet services and equipment procurement.

“I’m going there now to come to terms with what is the new matter, what is the new issue. Because he’s been there all this while and if there were serious matters of consequence and he’s on bail, huge bail, 80 million Ghana cedis bail,” he said.

He emphasized that Adu-Boahene had not absconded or attempted to flee the country. “He’s living nowhere and that of Angela. They are all over the nation, our borders and our airports. They are going nowhere.”

Calling for transparency, Atta Akyea urged state prosecutors to treat the case on its legal merits rather than political or personal motivations. “I believe that you should come clean that this is not a personal vendetta. This is a man that you believe you have some criminal case against and give him space to defend himself.” He said.

He also reminded the public that no offence, including murder, is non-bailable under Ghana’s constitution. “Give him also the freedom. There’s no case which is not bailable, including murders, provided always the exact or new conditions for it appear before the court to defend yourself.” He said.

Mr Adu-Boahene, who had earlier been detained over allegations regarding procurement practices and expenditure during his time at the National Signals Bureau, is now facing an additional layer of legal scrutiny, even as his defense insists he is ready to cooperate with investigations and defend his record. EOCO has yet to officially comment on the reasons behind the new arrest.
